PUBLIC OFFER for the Provision of Services for the Issuance of Tickets to Events (exhibitions)

This public offer (hereinafter, the "Offer") has been prepared in accordance with Clause 2 of Article 437 of the Civil Code of the Russian Federation and is addressed to any potential Purchaser of the Ticket Issuance Service for an Event|Exhibition.

This Offer defines the terms and conditions for the issuance, exchange and refund of the Ticket Issuance Service, as well as the rights and obligations applicable to attendance at an Event|Exhibition.

The Purchaser of the Ticket Issuance Service for an Event|Exhibition is strongly advised to read and familiarize themselves with the terms and conditions of this Offer.

Acceptance of this Offer shall be effected by the Purchaser of the Service by placing a special mark ("tick") in the web-based order form for a Ticket to an Event|Exhibition and/or by submitting an application to the Organizer via the relevant web form and/or by paying for the Ticket Issuance Service for the Event|Exhibition.

The terms and conditions of this Offer are available on the Organizer's Official Website at online.gefera.ru.

1. Terms and Definitions

1.1. For the purposes of the literal interpretation of this Offer, the following definitions shall apply:

"Offer Terms": means the terms and conditions set forth in this Offer, which may be amended or supplemented from time to time, including, without limitation, by publications on the Organizer's Official Website at online.gefera.ru.
"Purchaser of the Ticket Issuance Service for an Event|Exhibition": means an individual and/or legal entity applying to the Organizer or another person for the purpose of issuance, exchange or refund of the Ticket Issuance Service for an Event|Exhibition.
"Ticket to an Event|Exhibition": means a document containing a barcode and the full name of the holder, confirming the issuance of a Ticket to an Event|Exhibition and certifying the holder's right to attend the Event|Exhibition. The Ticket is generated by the Organizer's automated system.
"Event|Exhibition": means an event organized by the Organizer, attendance at which is carried out by means of a ticket issued, including through online payment.
"Organizer": means Gefera Media Limited Liability Company, TIN 7705365187, PSRN 1027700211417 dated September 12, 2002, registered office address: Premises IV, Room 43, Floor 2, Building 2, 72 Leningradsky Prospekt, Moscow 125315, Russian Federation, tel. +7 495 649 87 75, e-mail: info@gefera.ru.
"Cost of the Ticket Issuance Service for an Event|Exhibition": means the amount of funds corresponding to the cost of the service for issuance of a Ticket to an Event|Exhibition as established by the Organizer for all third parties.
"Reservation": means an Order generated and pending payment by the Purchaser.
"Promo Code": means a sequence of letters and numbers approved by the Organizer that certifies the Purchaser's right to pay the cost of the Ticket Issuance Service for an Event|Exhibition at a discount by reducing the cost of the Ticket to an Event|Exhibition in accordance with the rules governing the use of the relevant Promo Code.
"Force Majeure": means extraordinary and unavoidable circumstances under the given conditions, including, but not limited to, natural disasters, military actions, terrorist acts, mass disturbances, epidemics, strikes, acts and decisions of state authorities and local self-government bodies, restrictions on transport communications, blockage of payment infrastructure, disruptions in communications networks, and other similar events beyond the reasonable control of the Parties.

2. General Provisions

2.1. The subject matter of this Offer is the provision by the Organizer of services for the issuance of Tickets to an Event|Exhibition. The issuance of Tickets to an Event|Exhibition constitutes a service for arranging access to a business event and does not constitute the sale of an entertainment event within the meaning of the Law of the Russian Federation No. 3612-I dated October 9, 1992 "Fundamentals of the Legislation of the Russian Federation on Culture".

2.2. Tickets shall be issued exclusively on the terms and conditions of this Offer and only subject to its full and unconditional acceptance. Partial acceptance, as well as acceptance on any other terms, shall not be permitted.

2.3. Issued Tickets are non-refundable, and unilateral refusal from the terms of this Offer shall not be accepted on the grounds of the Purchaser's disagreement with the terms of this Offer or after acceptance thereof. Refunds for issued Tickets shall only be possible in the manner and on the terms established by this Offer and in accordance with the applicable legislation of the Russian Federation.

2.4. When Tickets are issued, the visitor, as an individual, shall receive an electronic cash receipt, which shall be sent by the payment system to the visitor's e-mail address specified during registration. No other accounting documents in respect of Ticket issuance shall be provided by the Organizer.

2.5. The Purchaser agrees that they shall not be entitled to use an issued Ticket for advertising goods, works or services of either the Purchaser or third parties, nor shall the Purchaser be entitled to subsequently resell issued Tickets to third parties.

2.6. While present at the Event|Exhibition Venue, the Purchaser of an issued Ticket to an Event|Exhibition shall behave respectfully and comply with all safety rules and instructions of the Organizer. The exercise of rights under the Ticket shall be subject to the access control, internal security procedures and venue rules applicable at the Event|Exhibition venue; the Organizer shall not be liable for access restrictions resulting from security measures and decisions of the Venue administration.

2.7. The description of the Event|Exhibition, the date, time and venue thereof, as well as the cost of the Ticket Issuance Service for an Event|Exhibition, are specified on the Official Website of the Event|Exhibition in the section dedicated to the event on the Organizer's website at online.gefera.ru.

2.8. Attendance at an Event|Exhibition by persons under eighteen years of age shall only be permitted if accompanied by adults. Access of persons under eighteen years of age to Events|Exhibitions assigned the "18+" information product category shall be prohibited. The procedure for admission of such persons shall be governed by the Rules for Attendance at Events organized by the Organizer.

3. Procedure and Terms for Provision of the Ticket Issuance Service

3.1. The Purchaser of the Ticket Issuance Service agrees that, prior to performing the actions constituting acceptance under this Offer, they have familiarized themselves with the terms and conditions of this Offer, as well as the Rules for Attendance at Events published on the Internet at: https://gefera.ru/pravila_posecheniya/, compliance with which is acknowledged as unconditional. The Purchaser of the Ticket Issuance Service confirms that the provisions of this Offer and other mandatory rules are fully understood by them.

3.2. In cases where the Purchaser of the Service acts through a representative, the Purchaser of the Ticket Issuance Service confirms that all actions/omissions of such person are performed by such representative with the Purchaser's knowledge, consent and in the interests of the Purchaser.

3.3. The Purchaser shall be entitled to pay for the Ticket Issuance Service using the following methods:

by means of a bank card (credit or debit) (cards of the following payment systems are accepted: Visa, MasterCard, MIR);
by entering a Promo Code provided by the Organizer or by the Organizer's partners authorized by the Organizer to distribute Promo Codes.

3.4. When issuing a Ticket, the Purchaser shall be obliged to fully verify all information regarding the Event|Exhibition specified on the Ticket, as well as the personal data provided to the Organizer, including the e-mail address to which the issued Tickets will be sent.

3.5. A Ticket shall not be sent to the Purchaser until full payment for the Ticket Issuance Service has been made. The Purchaser shall be deemed to have duly fulfilled their payment obligations at the moment when the full amount of funds is credited to the Organizer's settlement account.

3.6. Following full payment of the cost of the Ticket Issuance Service, the Purchaser shall independently print the Ticket, access to which is provided in the personal account on the Organizer's Website and/or sent to the Purchaser's e-mail address specified when placing the Order.

3.7. Upon entry to the Event|Exhibition, the Purchaser of the Ticket Issuance Service shall present a printed Ticket or an electronic copy of the Ticket sent to them by e-mail specified when placing the Order.

3.8. The Services shall be deemed duly rendered by the Organizer in full upon dispatch of the Ticket to the Purchaser's e-mail address specified by the Purchaser during Ticket issuance or upon granting access to the Ticket in the Purchaser's personal account on the Organizer's Website.

3.9. Following provision of the Services in accordance with the preceding clause, the Purchaser shall not be entitled to refuse the Services or demand a refund of the cost of the Ticket Issuance Service, except in cases expressly provided for by the section "Procedure and Conditions for Refunds" of this Offer and by the applicable legislation of the Russian Federation.

4. Personal Data

4.1. When completing an application for issuance of a Ticket to an Event|Exhibition, the Purchaser of the Ticket Issuance Service grants full consent to the Organizer's processing and use of the personal data specified during registration and Ticket issuance in accordance with the Organizer's personal data processing policy published on the Organizer's website at: https://online.gefera.ru/konfidentsialnost.php.

5. Liability of the Parties

5.1. For failure to perform or improper performance of the terms and conditions of this Offer, the Parties shall bear liability in accordance with the legislation of the Russian Federation.

5.2. The aggregate liability of the Organizer to the Purchaser in respect of any claims related to this Offer, including claims for refunds and damages, shall not exceed the amount of the cost of the Ticket Issuance Service for the relevant Event|Exhibition actually paid by the Purchaser. Under no circumstances shall the Organizer compensate lost profits or any indirect, incidental, consequential or special damages, including those related to loss of profit, business reputation or interruption of the Purchaser's business activities.

5.3. The Organizer shall not be liable for any discrepancy between the Event|Exhibition and the expectations of the Purchaser of the Ticket Issuance Service for the Event|Exhibition.

5.4. The Organizer shall not bear liability and shall not compensate the Purchaser of the Ticket Issuance Service for an Event|Exhibition for any losses caused by failures arising from problems in the operation of the Organizer's automated system or temporary unavailability of access thereto preventing the Purchaser from placing an order for the Ticket Issuance Service for an Event|Exhibition.

5.5. The Purchaser of the Ticket Issuance Service for an Event|Exhibition shall bear full liability under the applicable legislation of the Russian Federation for consequences arising from the provision of inaccurate or knowingly false information to the Organizer or to a third party representing the Organizer's interests, as well as for violation of the rights and interests of other persons resulting from such actions.

5.6. The Parties shall not bear liability for failure to perform or improper performance of the terms of the Offer caused by force majeure circumstances.

5.7. The Purchaser of the Ticket Issuance Service for an Event|Exhibition may not, without the Organizer's prior written consent, resell or transfer (for commercial or other personal gain) any Ticket(s) to an Event|Exhibition or issue Ticket(s) to an Event|Exhibition through a seller who is not the Organizer or the Organizer's authorized agent.

5.8. Issued Tickets to an Event|Exhibition may not be used for advertising, promotional or commercial purposes, including giveaways, competitions, contests and sweepstakes, nor may they be included in package offers together with hospitality products (such as catering, transfers, accommodation, souvenir products, etc.), except where previously approved by the Organizer in writing.

5.9. The Organizer reserves the right to deny entry to the Event|Exhibition Venue (or remove from the Event|Exhibition Venue) any Purchaser of the Ticket Issuance Service for an Event|Exhibition whose Ticket to the Event|Exhibition was issued or used in violation of the terms and conditions of this Offer. Such denial of entry or removal from the Event|Exhibition Venue on the above grounds shall not constitute cancellation or postponement of the Event|Exhibition and shall not give rise to any obligation to refund the cost of the Ticket Issuance Service.

5.10. The Purchaser of the Ticket Issuance Service for an Event|Exhibition shall independently bear responsibility for compliance with all immigration, customs and legal requirements of any relevant authorities for entry into the territory of the Russian Federation (including, without limitation, obtaining an entry visa or permit). No exchange or refund of the cost of the Ticket Issuance Service shall be provided due to the Purchaser's non-compliance with such requirements or inability to obtain (or refusal, cancellation, expiration or revocation of) an entry visa or permit for any reason whatsoever.

5.11. Without the Organizer's prior written consent, the Purchaser of the Ticket Issuance Service for an Event|Exhibition shall not:

5.11.1. remain at the Event|Exhibition Venue outside the hours of the Event|Exhibition;
5.11.2. place, affix or display any poster, placard, banner, printed or other advertising material at the Event|Exhibition venue;
5.11.3. distribute printed publications and materials or distribute, display or promote any advertising or promotional materials, samples of goods or services, or any other type of products at the Event|Exhibition venue;
5.11.4. distribute, vend, sell, offer or display for sale any goods or collect money for orders of goods and services at the Event|Exhibition venue;
5.11.5. sell, offer or display for sale any issued Ticket to an Event|Exhibition;
5.11.6. leave litter anywhere other than in specially designated receptacles;
5.11.7. interfere with, interrupt or behave in a manner capable of disrupting or interrupting any procedure, event or activity of the Organizer;
5.11.8. use indecent or obscene language, threatening or abusive words, or otherwise behave in a threatening, disorderly, indecent or offensive manner;
5.11.9. smoke in prohibited areas;
5.11.10. perform any actions aimed at circumventing or violating the access control systems of the Event|Exhibition Venue, including counterfeiting, copying or otherwise unlawfully using the Ticket and/or its details.

5.12. The Purchaser of the Ticket Issuance Service for an Event|Exhibition shall be entitled to attend the Event|Exhibition on the dates specified on the Ticket to the Event|Exhibition. The validity period of the issued Ticket is specified on the Ticket.

5.13. One person only may enter using one issued Ticket to an Event|Exhibition. Transfer of an issued Ticket to an Event|Exhibition to another person during the entire day of the Event|Exhibition is prohibited.

6. Distribution of Event Information

6.1. By agreeing to this Offer, the Purchaser of the Ticket Issuance Service for an Event|Exhibition consents to the Organizer or a third party acting with the Organizer's authorization carrying out regular mailings containing information relating to the Event|Exhibition to the e-mail address and/or mobile telephone number specified by the Purchaser of the Ticket Issuance Service when purchasing the Service. The scope and content of the relevant informational mailing, as well as the timing and duration thereof, shall be determined independently by the Organizer.

6.2. The Purchaser of the Ticket Issuance Service for an Event|Exhibition shall be entitled at any time to unsubscribe from the aforementioned mailings by sending an electronic notice to the Organizer or a third party acting with the Organizer's authorization in accordance with the instructions contained in the relevant message (mailing).

7. Payment Procedure

7.1. Payments shall be processed through the authorization server of the Bank's Processing Center using bank cards of the following Payment Systems:

VISA International
MasterCard Worldwide
MIR

7.2. To make a payment, you will be required to provide your bank card details. Transmission of such information is carried out in compliance with all necessary security measures. The data shall only be transmitted to the Bank's authorization server via a secure channel (TLS protocol). Information is transmitted in encrypted form and stored only on a specialized server of the Payment System. The website and the store do not know and do not store your bank card details.

7.3. If payment by bank card is selected, payment for the order shall be processed immediately after placement thereof. Upon completion of the order placement in our store, you must click the "Pay by Card" button, whereupon the system will redirect you to the authorization server page where you will be prompted to enter your bank card details and initiate authorization thereof, after which you may return to our store by clicking the "Return to Store" button. After returning to our store, the system will notify you of the authorization results. If authorization is confirmed, your order will be automatically fulfilled in accordance with the conditions specified by you. If card authorization is denied, you may repeat the payment procedure.

8. Procedure and Conditions for Refunds

8.1. Refunds for the Service shall only be made in the event of cancellation or postponement of the Event|Exhibition.

8.2. Only Tickets issued by the Organizer shall be accepted for refund/exchange. Refunds for the Ticket Issuance Service shall be made in the amount of the cost of the issuance service.

8.3. If payment for the Ticket Issuance Service was made using a Promo Code, the cost of the issuance service shall not be refundable.

8.4. Changes to the Event|Exhibition program, composition of participants and exhibitors, list of speakers, insignificant changes to the Event|Exhibition operating hours, as well as redistribution of the exposition shall not be deemed cancellation or postponement of the Event|Exhibition and shall not give rise to a refund of the cost of the Ticket Issuance Service.

8.5. Any other fees and payments expressly designated as non-refundable during Ticket issuance and/or in the relevant information on the Official Website of the Event|Exhibition shall not be refundable, except in cases expressly provided for by the legislation of the Russian Federation.

8.6. In order to receive a refund, the Purchaser of the Ticket Issuance Service undertakes to provide the Organizer with:

a refund application;
Tickets;
a cash receipt.

8.7. The above documents shall be sent to the following e-mail address: info@gefera.ru.

8.8. Funds for lost, damaged (before/during/after the date of the Event|Exhibition) or unused issued Tickets shall not be refundable.

8.9. In the event of cancellation of the Event|Exhibition, refunds for the Ticket Issuance Service shall be made by the Organizer within 10 days following announcement of the cancellation or postponement. Refunds for the Service paid for using a Promo Code shall not be made.

8.10. In the event of postponement of the Event|Exhibition, the Ticket shall remain valid for the new date of the Event|Exhibition, and refund of the cost of the Ticket Issuance Service shall only be made upon a separate application from the Purchaser.

8.11. Refunds for the Ticket Issuance Service purchased by bank card on the Organizer's website shall be made to the same card used for payment.

9. Dispute Resolution Procedure

9.1. Any dispute arising in connection with the interpretation or application of this Offer shall be resolved by the Parties through submission of a claim to the other Party. The period for review of the claim shall be 10 business days from the date of receipt.

9.2. If the Parties fail to reach an agreement, the dispute shall be resolved by the judicial authorities at the location of the Organizer in accordance with the established procedure, unless otherwise provided by mandatory provisions of the legislation of the Russian Federation.

10. Final Provisions

10.1. This Offer shall enter into force from the date of its publication on the Official Website of the Event|Exhibition.

10.2. The Organizer shall be entitled at any time to amend this Offer, provided that all amendments are mandatorily published and brought to public attention by publication on the Official Website of the Event|Exhibition. Amendments to the Offer shall not have retroactive effect, i.e. shall not apply to civil law relations arising prior to publication of such amendments.

10.3. The Organizer shall be entitled to terminate the Offer at any time without prior notice to the Purchaser of the Ticket Issuance Service for an Event|Exhibition in the event of violation by the latter of the terms and conditions of the Offer.

10.4. Amendments to the terms and conditions of this Offer shall be valid and binding provided that they are made or confirmed by the Organizer and published on the Official Website of the Event|Exhibition.

10.5. The terms and conditions of this Offer are drawn up in Russian and English. In the event of any discrepancy between the Russian and English versions, the Russian version of the Offer shall prevail.

10.6. The terms and conditions of this Offer shall in all respects be governed by, interpreted and applied in accordance with the legislation of the Russian Federation.
